General Terms and Conditions for Offers

These terms and conditions as well as any amendments thereof are part of a contract between you and One MobiKwik Systems Limited ("MobiKwik") and govern the use of MobiKwik Wallet Offers referred to as ( "Offer" / Promotions " / Deals " / Coupons" / Bonus " / Gifts " / Vouchers " ) which is / are subject to the following terms and conditions of use (Conditions" and/or Terms"). If you do not agree to abide by the Conditions, please do not review, refer, use, access, avail, claim redeem and or download the offers".

By participating in MobiKwik's Offer, MobiKwik Wallet Users agree to be bound by these terms & conditions and waive any right to claim ambiguity in these terms & conditions. MobiKwik Wallet Users agree to release, discharge, indemnify and hold harmless MobiKwik, and its directors, officers, employees and agents, from and against any loss, claims, damages or liability resulting in whole or in part, directly or indirectly, from acceptance and/or participation in the Offer.

Offers from MobiKwik is / are open to select residents of India ( 18 Years + ) having a valid MobiKwik Wallet Account in good standing.

Please refer at all times to the special conditions, which may apply to individual MobiKwik Wallet Users detailed on the https://www.mobikwik.com website. It is always advisable to reconfirm any such special conditions.

1. Offers are obtained / redeemed upon presentation of a valid voucher / code as the case may be.
2. The validity dates of the offer are stated on the particular offer and/or on the MobiKwik Website and are subject to dates and times, unless otherwise stated.
3. MobiKwik accepts no liability for lost or stolen Offer Codes. MobiKwik shall not be liable for any hacking or unauthorized use of the Wallet Users Account and it shall be the sole responsibility of the MobiKwik Wallet User to ensure privacy and confidentiality of his Wallet Account.
4. Unless otherwise specified, some Offers cannot be clubbed with any other offers that may be available to MobiKwik Wallet Users under any other prevailing scheme or offer.
5. MobiKwik reserves the right to extend or terminate this Offer without prior notice. MobiKwik reserves the right at any time, without prior notice, to add/alter/modify/change or vary all of these Terms & Conditions or to replace wholly, or in part, this Offer by other offer(s), whether similar to this Offer or not, or to withdraw it altogether.
6. The offer may not be available wherever prohibited and products/ services for which such programs cannot be offered for any reason whatsoever.
7. MobiKwik shall not be obliged to make any public announcements to intimate the successful Wallet Users about the cash back under the offer.
8. Any person taking the advantage of this offer shall be deemed to have read, understood and accepted these terms and conditions
9. MobiKwik Wallet Users are requested to be accustomed, satisfy and agree to with these and the terms and conditions of the Offer of MobiKwik before participating in or making any purchase in relation to this Offer. Participation in the Scheme is discretion of the MobiKwik Wallet User and it shall not, in any way, affect the performance of the product purchased under the Offer.
10. Any disputes regarding delivery, service, suitability, merchantability, availability or quality of the Offer and/or products/services provided by third party under the offer must be addressed in writing by the Wallet User directly to the third party and MobiKwik will not entertain any communication in this regard.
11. The decision of MobiKwik will be final & binding on all the Wallet Users participating in this offer and that the same is non-contestable.

13. Cashback is given only to the MobiKwik Wallet Users who are eligible as a part of the Offer on their MobiKwik Wallet.
14. Decision of MobiKwik about eligibility of MobiKwik Wallet User for any offer is final and binding
15. Any disputes arising out of this offer shall be subject to arbitration under the Indian Arbitration and Conciliation Act, 1996 including any statutory amendments carried thereof. Arbitration shall be conducted by a sole arbitrator appointed by MobiKwik for this purpose and the award of the arbitrator shall be final and binding on the MobiKwik Wallet User and MobiKwik. The Place of arbitration shall be New Delhi and the language of arbitration shall be English. Existence of a dispute, if any, shall not constitute a claim against MobiKwik.
16. Cash-back amount credited to the MobiKwik Wallet Users account shall be valid for a certain period as may be specified and beyond which the same will expire.
17. The MobiKwik Wallet User will receive a cash-back for all payments made through MobiKwik. The cash-back will be credited back to the MobiKwik Wallet User’s Wallet, which may then be used for paying for goods or services provided by MobiKwik’s Seller partners.
18. In event the MobiKwik Wallet User initiates a refund in respect of a transaction, the amount of cash-back credited to the Wallet shall be debited. In event of initiation of a refund, where the balance credited to the User’s Wallet as cash-back has been utilized by the Wallet User towards purchase of goods/services, the Wallet shall be debited by the amount of cash-back and in case the Wallet has zero balance, the Wallet shall show a negative balance equalling the amount of cash-back. Where the cash-back is utilized towards a new transaction and a refund is initiated with respect to such new transaction, the cash-back from the original transaction shall be credited back to the Wallet while the cash-back from the new transaction shall be debited from the Wallet Account of the User.
19. MobiKwik Wallet Users whose account has been classified as delinquent before or during the currency of the offer will not be eligible for the benefits of the offer. MobiKwik’s discretion in this regard shall be final.
20. MobiKwik reserves the right to disqualify any Wallet User from the benefits of the offer if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the offer or otherwise by use of the Wallet Account.
21. All taxes, duties, levies or other statutory dues and charges payable in connection with the benefits accruing under the offer shall be borne solely by the MobiKwik Wallet User and MobiKwik will not be liable in any manner whatsoever for any such taxes, duties, levies or other statutory dues.
22. The items/products on Merchant / Third Party website are by independent sellers who are responsible and liable for complying with their commitments/communications including but not limited to guarantees/warranties and services [pre or post sales] and applicable law of the land. MobiKwik does not hold out any warranty or make any representation of the delivery, quality, merchantability, suitability of the products and services offered on the Merchant / Third Party Website.
23. Users are not bound in any way to participate in the Offer. Any such participation is voluntary.
